Section 504
In compliance with its obligations under both Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act, Walter Maginnis High School (WMHS) does not discriminate against otherwise qualified students with disabilities in the provision of its educational programs and activities. It is the responsibility of WMHS to identify and evaluate learners who, within the intent of Section 504, need services, accommodations, or programs in order to receive a Free Appropriate Public Education (FAPE). A learner who is protected under Section 504 is one who: 1. has a physical or mental impairment that substantially limits one or more of such person’s major life activities; or 2. has a record of such an impairment; or 3. is regarded as having such an impairment. Learners may be protected from disability discrimination and be eligible for services, accommodations, or programs under the provisions of Section 504 even though they are not eligible for special education pursuant to the Individuals with Disabilities Education Act. A Section 504 Administrative Liaison manages the district’s compliance with Section 504, including grievance procedures; provides assistance to any parent/student or staff member in initiating a Section 504 referral at the facility level; and monitors the District’s referral, identification and review process. A Section 504 Building Coordinator provides any parent, student or staff member the opportunity to initiate a Section 504 referral; coordinates the school’s referral, identification and review process; and facilitates Section 504 meetings. An ADA Coordinator oversees the ongoing efforts for full ADA compliance including coordinating and monitoring ADA accommodations; developing processes for prompt fulfillment of requests for alternative formats, interpreting services and other communication access needs; and overseeing the development of plans to remove access barriers.
